Please get it certified from the ESI doctor that he is unable to work. Until he becomes fit, ask him to go on sick leave again under ESI/LOP, whichever may be the case.
As per the law, if he is not able to perform such a job, the company should assign another job which he can perform. Alternatively, another way is to make some settlement with him for resigning.

Dear Madam,Regarding your queries, please note that if the employee exceeds the salary brackets of Rs. 21,000 gross per month, in that case, you have to keep him in ESIC until the recent contribution period is over, i.e., up to 30.09.2024.
Under ESIC, it is not required to contribute if a member is earning more than 21,000\. However, they must continue to contribute until completing the contribution period, even if the member is earning more than 21,000.
